With a court decision expected tomorrow on whether Fight-HST organizers will be granted an injunction that forces Elections B.C. to forward its validation of an anti-HST petition to the B.C. government, Doug McArthur is ready. The SFU public policy analyst remains readily on hand to comment on the latest developments in this turbulent tax tale. “It would be constitutionally absurd,” advises McArthur, “to rule that the B.C. legislature cannot reverse the provincial part of the HST. But, the judge may find that breaking the agreement with the federal government will require 18 months notice, meaning another long delay. However, technical problems could be fixed by the legislature if the bill is forwarded to it.”
