The ever-increasing popularity of restorative justice responses to crime presents a challenge to community-based restorative justice initiatives, as the provincial and federal governments move to appropriate, compartmentalize and administer restorative practices in “criminal” matters. The end result of this “appropriation” is the equation of restorative justice with “diversion”, which undermines the potential of restorative justice and limits its application to minor, non-violent, first time offences. This paper will explore and compare the challenges faced in implementing, maintaining, and sustaining both an urban Aboriginal justice program and a non-Aboriginal youth restorative justice program. The intention is to increase understanding and awareness of the context in which they have emerged and promote discussion of their ability to change the way the criminal justice system conducts business.
