Indemnities

Any document, contract, or agreement which contains an indemnity statement or clause, must be reviewed by the University prior to being finalized and executed by the authorized signing officer. In accordance with SFU policy AD3.14, you may forward the document to the Risk Manager for review.

Waivers

A waiver is a document outlining the risks of participating in an activity and requiring the participant to acknowledge those risks and agree to indemnify (compensate) the University for losses they cause to other people or other people’s property and to waive their right to make a claim against SFU for injuries to themselves or losses to their own property.

Waivers are generally used for individuals participating in a voluntary SFU activity where the risks may be hidden to the participant (due to lack of familiarity with the activity or some other cause), or where the outcome of the risks is particularly serious resulting in personal injury such as broken bones, head injuries, or financial loss.

Assumption of Risk Forms

An assumption of risk form is a document outlining the risks of participating in an activity and requiring the participant to acknowledge those risks and to indemnify (compensate) the University for losses they cause to other people or other people’s property.  These documents are generally the same as waivers except they don’t include the clause where the participant waives their rights to make a claim against SFU.

Requirement for Due Diligence

Regardless of which document is used, the Department or the personnel leading or organizing the event or activity are responsible for ensuring that they (and the people for whom they are responsible) are being duly diligent.  This means that they have identified, assessed and determined how to mitigate the various risks of the activity.

Obtaining a Waiver or Assumption of Risk Form

Once you prepare a list of the potential risks, please contact Risk Management. Each Waiver or Assumption of Risk form must include a contact person or title of person from whom the person signing the document can obtain more information about the activity risks.
