Residential unit resales (UniverCity)

SFU is the lessor of the ground lease granted to the lands at UniverCity.  The lessor, the lessee, and the mortgagee of the UniverCity lands have certain obligations under the ground lease.  Therefore, all real estate transactions at UniverCity requires consent from SFU.

For purchasers buying new strata lots from a developer, please contact the applicable developer directly regarding the closing procedure.

For lawyers and notary publics acting for purchasers of Strata Lots in UniverCity from individual vendors, (i.e. resales of UniverCity lots) please follow the 'Closing Instructions for Resale' found below. Please do not make changes to the standard templates downloaded from this page. SFU will not execute a document if changes are made, and unauthorized changes will lead to an increase in processing time of your document.

Closing instructions for resale (Updated April 2024)

All closing documents submitted for execution by Simon Fraser University must include:

1. The 'Schedule A - Letter from Purchaser's Solicitors',

2. 'Assignment of Lease'

3. Cheques, made payable to Simon Fraser University for administration. Please note that SFU will not process documentation until the appropriate fees have been received. Administration fees for processing documents are as follows:

  • If given 3 business days, an administration fee of $165, plus GST, is required to execute the Assignment of Lease and/or the Tripartite Agreement.
  • If given less than 3 business days, an administration fee of $330, plus GST, is required to execute the Assignment of Lease and/or the Tripartite Agreement.
  • If a certificate is required by the "Mortgagee", an administration fee of $71, plus GST, is required to execute the certificate.
  • A soft copy of the university executed documents is included in the administration fee. Request for additional hardcopy originals will incur a fee of $50 for each additional copy.
  • Any request for changes after SFU has executed the document will incur an administration fee of $67, plus GST. If the Tripartite Agreement is sent to us after we have already returned an executed copy of the Assignment of Lease, a further fee of $67.00 plus GST will be required.

FREQUENTLY ASKED QUESTIONS – UNIVERCITY RESALES

Q: If the notary needs to file transmission of surviving Joint tenants, does SFU require to sign off on the documents?
A: SFU is not required to consent to a change in surviving Joint Tenancy.

Q: Does the notary need to request SFU’s consent for an amendment or correction of a documents prior to it has been filed with the Land Title Office?
A: Yes.  Any defect corrections, edits, or changes made to the signed documents that have been signed and returned to the Notary/Lawyer from SFU, the Notary/Lawyer must seek written consent from SFU prior to filing any changes/amendments with the Land Title Office. 

Q: As a real estate agent, I am new to leasehold properties.  Can you please shed some light on the terms of the leasehold agreement and who the properties belong to?
A: The terms and conditions of this leasehold are covered in the ground lease (sometimes referred to as the “Headlease”).  The purchaser will need to consult with legal counsel to provide them with legal advice regarding the lease and its significance.

Q: Can I please get a copy of the ground lease for my property?
A: A copy of your ground lease can be obtained through: BC Land Tittle and Survey Authority (LTSA), your lawyer/notary, or your real estate agent.

Q: Please advise me of your GST number, our accounting department requires it in order to issue the cheque.
A: SFU GST number is 118520725 RT0001.

Q: I'm in process of buying a unit in one of the UniverCity buildings.  My buying agent realized her notary does not do leasehold property closings. Would you be able to recommend a notary or lawyer who is familiar with this type of transaction?
A: As SFU is a public corporation.  As such, we cannot make personal recommendations for any one particular legal counsel.  We direct you to the BC Law Society Lawyer Directory website (https://www.lawsociety.bc.ca/lsbc/apps/lkup/mbr-search.cfm) or the BC Notaries website (https://www.bcnotaryassociation.ca/find/).

Q: Does SFU accept Credit Cards or e-Transfers for the payment of the Real Estate fees?
A: SFU accepts trust cheques, certified funds, or bank drafts.   

Q: Your website mentions a Certificate.  What is a Certificate for?
A: The certificate is a letter that can be provided by SFU that states to your Lender that the Ground Lease remains in effect, the base rent under the lease has been paid and that, to SFU's knowledge (without making inquiries), the other party is not in default under the lease.

Q: I don’t have any mortgage information.  Can I send you a partial package with the mortgage documents at a later time? Does this negate the “rush” charge?
A: SFU requires that all documents be completed and signed prior to our execution. We will do our best to return the executed documents in a timely manner. Any documentation that requires signatures will be charged a rush fee if they are received within the rush fee window.
